Terms of Use — Ninth Minute

These Terms govern your use of the Ninth Minute mobile app and related APIs. Privacy is in the Privacy Policy. If you do not agree, do not use the app.

This is not a medical, therapy, or emergency service. Nothing here is a promise that you will quit a habit, that a craving will end at a particular minute, or that we will intervene if you are in crisis.

1. Who may use the app

You must be at least 18 (or the age of majority in your place of residence, if higher). The app can be used to track adult categories (including alcohol, nicotine, gambling, and pornography). It is not for children.

We do not create a Ninth Minute account. Your identity with us is a device-generated install ID. Your paid status is tied to your Apple ID or Google account.

2. What the app is — and is not

Ninth Minute is a consumer habit tracker: counters, an urge timer, optional local reminders, optional on-device “risk” suggestions, optional site/app blocking you configure, and optional paid insights.

You agree that Ninth Minute is:

The phrase “ninth minute” and any timer or statistic in the app is derived from your own log (or is a generic timer). It is not a claim that cravings last a fixed time for everyone. Do not treat in-app numbers as clinical fact.

If you are in danger, suicidal, overdosing, or otherwise need urgent help, contact local emergency services or a local crisis line. Do not rely on this app.

3. Your content stays yours — and on your device

You are solely responsible for what you log. That content is stored on your device and, if you enable it, in your iCloud. We do not host a copy we can read. Export passphrases are your responsibility.

4. Permissions, blocker, Health, Calendar, notifications

Optional OS permissions improve on-device features. You may refuse them; free counters still work.

Screen Time / Family Controls blocker: You choose what to block. We do not warrant that a site or app will always be blocked, that a delay cannot be bypassed, or that the blocker is suitable as clinical treatment.

HealthKit: Read-only sleep hours, on device, if you allow it. We do not write to Apple Health.

Calendar: Free/busy only; event titles are not stored.

Notifications: Scheduled on the device. We do not send marketing push for your habit log.

Partner: Opens your messaging apps. The other person has no Ninth Minute account.

5. Crisis listings

Helpline names, numbers, or URLs are third-party public resources. We do not operate them or guarantee they are reachable or correct. You must verify a number before relying on it. Do not wait on this app in an emergency.

6. Subscriptions and payments

Paid features are sold as auto-renewing In-App Purchases through the App Store or Google Play, not through us.

Payment: Charged to your Apple ID or Google account at the price shown by the store at checkout.

Current iOS product IDs (may change): nm_yearly_v1 (yearly), nm_weekly_v1 (weekly).

Auto-renewal (Apple): Payment is charged to your Apple ID. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. Manage or cancel in Settings → [your name] → Subscriptions (or apps.apple.com/account/subscriptions).

Google Play: Manage or cancel in Play Store subscription settings.

Restore: Use Restore purchase on the same store account. A subscription may be bound to at most three installs.

Refunds: Through Apple or Google under their rules. We cannot override store refund policy.

If you cancel: You keep paid access until the end of the period already paid. Counters, the log, and money saved remain available on the free tier. Cancelling does not delete on-device data.

7. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Ninth Minute on devices you own or control, in accordance with App Store or Play Store rules. You may not scrape our APIs, commercially resell a subscription, or misrepresent purchase tokens.

8. Acceptable use of our servers

Our API confirms purchases, ships signed public content, and accepts optional anonymous events. You must not send slips, answers, or other log content to us.

9. No warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that suggestions or risk windows are accurate, that blocking will work, that helplines are complete, or that using the timer will change a health outcome. Some places do not allow certain disclaimers; there, our responsibility is limited to what that law requires.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: we are not liable for decisions you make based on the app, missed blocks, third-party helplines, iCloud loss, or store billing disputes; we are not liable for indirect or consequential damages; our total liability is limited to the amount you paid through the store for Ninth Minute in the 12 months before the claim (often zero on the free tier).

We do not exclude liability that the law of your country says we cannot exclude (for example death or personal injury caused by our negligence, or fraud, where such an exclusion is void).

11. Apple and Google

If you downloaded from the App Store: these Terms are between you and Elixent only, not Apple. Apple has no obligation to provide maintenance or support. If a warranty that cannot be disclaimed fails, you may notify Apple and Apple may refund the app purchase price; to the maximum extent permitted by law Apple has no other warranty obligation. Apple is not responsible for claims relating to the Licensed Application. Apple and its subsidiaries are third-party beneficiaries of these Terms. You represent you are not in a U.S. embargoed country and not on a U.S. denied-party list.

Nothing in these Terms reduces rights Apple or Google require you to have, or mandatory consumer-law rights.

12. Changes

We may update the app, content, and these Terms. We may discontinue the backend. On-device features are intended to keep working with cached data; that is not a guarantee of perpetual servers.

13. Governing law

Laws of India, except that App Store / Play rules and Apple’s Licensed Application EULA apply to distribution, and mandatory consumer protections of your country of residence still apply where they cannot be waived. Courts of competent jurisdiction in India, except where a mandatory law lets you sue at home.

15. Entire agreement

These Terms and the Privacy Policy are the entire agreement for Ninth Minute. If a clause is unenforceable, the rest remains.
